Innovations In Memory LLC

Cisco (2:24-cv-00360) is the second defendant to be sued in the litigation campaign that Delaware plaintiff Innovations In Memory LLC (IIM) launched earlier this month with a suit against IBM. In the new Eastern District of Texas complaint, the plaintiff asserts three patents described as “concerning improvements in memory storage devices and systems”. Cisco is accused of infringement through the provision of a wide array of products, ranging from its “MDS 9000 Series Switches” to its “Unified Computing System”.

Last July, RPX noted that the recordation of the 2021 transfer of a portfolio of memory patents to Innovations In Memory LLC (IIM). Five of those patents have now appeared in litigation, IIM accusing IBM (2:24-cv-00296) of infringing them through the provision of a wide array of memory products, including the IBM Diamondback tape library, IBM SAN Volume Controller products, IBM Storage Virtualize software, Storage Scale System, and more.

In 2021, a portfolio of more than 90 US patents (plus foreign counterparts) originating from “all-flash pioneer” VIOLIN Systems (f/k/a Violin Memory) was assigned to a Delaware NPE. The recent recordation of that transaction is notable, as well as the identity of the new patent holder—as together, they suggest that a new litigation campaign is imminent.
