A jury in the Eastern District of Texas awarded EON Corp. IP Holdings $18.8 million in the NPE’s litigation against Silver Spring Networks. EON sued Silver Spring along with Aclara Powerline Systems, Elster Solutions, Itron, Landis+GYR, and Trilliant Networks in June 2011, alleging infringement of a group of patents related to wireless communication (5,388,101, 5,481,546, 5,592,491). Defendants’ two-way communication networks, components, software, and services were the accused products. All three patents involved in this case have been previously asserted by EON; between September 2008 and May 2013 the entity sued more than 90 companies for alleged infringement of one or more of the patents including Amazon, Blackberry, Cisco, Google, HP, HTC, Motorola, Nokia, Samsung, and T-Mobile. EON’s cases against Apple, ASUS, LG, and Pantech are ongoing and have been consolidated for pretrial purposes. All of EON’s other cases have terminated with the exception of its suit against AT&T and Verizon, which is still in litigation. Silver Spring was the only remaining defendant when trial began last week—according to court documents, all five of the other defendants settled with EON. Following a four-day trial, the jury found that Silver Spring directly infringed multiple claims of each of the patents-in-suit and had failed to prove that any of the asserted claims were invalid. 6:11cv00317
