Diamond Coating Technologies, LLC (DCT) has hit reset on two separate cases that it filed against Hyundai and Nissan to kick off this litigation campaign in September 2013 . A California district court dismissed those earlier actions without prejudice on April 1, 2015 for lack of standing. Following a considerable period of discovery, as well as a claim construction ruling (adopting many of DCT’s proposed constructions), Judge Mariana R. Pfaelzer ruled that Sanyo, the original assignee, retained sufficient rights in the patents-in-suit to require joinder to DCT’s cases. Sanyo would not join, and the suits were dismissed.
