Phoenix Licensing filed 15 suits against a range of companies, including Charter, Cox, Dish, Honda, Hyatt, Hyundai, Kohl’s, Macy’s, Southwest Airlines, Telephone and Data Systems, Time Warner Cable, and T-Mobile. Phoenix alleges defendants’ customized communications to customers are infringing a group of marketing technology patents (5,987,434, 6,999,938, 7,890,366, 8,234,184, 8,352,317, 8,606,632, 8,738,435). The patents-in-suit relate to the automatic selection of products and services for clients and the personalization of communications offering the selected products. The accused personalized communications include letters, emails, and notices to customers regarding financing offers, discounts, and rewards.
