Empire IP’s CreateAds filed seven suits against A Weber Systems, Constant Contact, Costco, CVS, Mediawide, MyPublisher, Rite Aid, Shutterfly, and VerticalResponse, alleging that the defendants’ websites infringe a patent related to the use of design templates (5,535,320). Since November 2012, CreateAds has 43 defendants including a variety of e-retailers, website operators, and e-commerce technology and design software providers. The patent-in-suit was assigned to Empire IP by Automated Reprographics Technologies in April 2012, and was later assigned to CreateAds by Empire IP in November of the same year.
