February 28, 2013- Congressman Peter DeFazio introduced a bill on February 25th to amend US Code Title 35 to give defendants the ability to recover “full costs” (including attorney fees) if they prevail in patent suits filed by NPEs. The award may be made if the plaintiff is not one of: 1) the original inventor or the original assignee, 2) commercially practicing the patented invention, or 3) a university or technology transfer organization.
