DigiMedia Sues Four Radio Broadcasting Companies over Music Storage and Delivery

DigiMedia Holdings Group, previously known as Mission Abstract Data, filed four separate suits against Access.1 Communications, Hunt Country Radio, NM Licensing, and Tomlinson-Leis Communications alleging that the defendants’ radio station equipment and infrastructure infringe two patents related to the way music is stored on hard drives, how new music is acquired across networks digitally, and the delivery of music on those hard drives to others (5,629,867 and 6,809,246). Mission previously filed suit in March 2011 against several broadcasters, alleging infringement of the patents through broadcasting music from a hard-drive. According to the USPTO database, DigiMedia is the assignee of four patents and one published application. Of the four patents which the company owns, two of the patents, ‘867 and ‘246, were put into an ex-parte re-exam by Broadway Electronics as part of an ongoing litigation between DigiMedia and several large corporate radio stations. The patents-in-suit were assigned to Mission by Haltek America in July 2007. In Feb. 2011, Mission changed its name from Intellectual Ventures Audio Data, which assigned the patents-in-suit to DigiMedia through its assignor’s interest in Feb. 2012. 2/14, Eastern District of Texas, 2:2013cv00131, 2:2013cv00132, 2:2013cv00133, 2:2013cv00134.
