EMG Technology Sues Discover and General Mills over Mobile Web Browsing

EMG Technology filed two separate suits against Discover Bank and General Mills (with Romano’s Macaroni Grill) alleging that the defendants’ websites that can be reformatted for use on portable devices and cellular phones capable of browsing the Internet using a small screen infringe a patent related to reformatting HTML content for display on a mobile device (7,441,196).  The patent-in-suit is one of two patents that EMG has asserted against more than 60 companies since 2008. The patent-in-suit received a re-examination certificate (attached as an exhibit to each of the complaints) in 2011 that affirmed the validity of the claims as amended, adding a limitation that a link be provided to navigate to a “sister site.” EMG is a patent assertion entity managed by inventors Elliot Gottfurcht, Grant Gottfurcht and Albert-Michael Long.  2/7, Eastern District of Texas, 6:2013cv00133; 6:2013cv00134.
