Brandywine Communications Technologies filed six separate suits against Chatham Hill Group, Dakota Communications, Datum Communications, Empire One Telecommunications, Gutierrez-Palmenberg , and Internet Holdings alleging that the defendants’ DSL modems, services, and equipment infringe six patents related to DSL and modem based communications (5,206,854; 5,251,328; 5,812,537; 5,828,657; 6,970,501; 7,894,472). Since December 2012, Brandywine has filed similar suits against over 50 ISP’s with the same patents. Brandywine currently has over 70 active cases, including a declaratory judgment against Brandywine, filed on January 10, by medical device company Estech. The patents-in-suit were assigned to Brandywine by Rembrandt IP in 2010 and were part of a portfolio of patents from AT&T/Lucent spinout/DSL chip provider Paradyne that Rembrandt IP acquired in 2006 from Paradyne acquirer, Zhone. RPX reviewed the patents as an open market opportunity (Rembrandt_DSL-Acq) in February 2010. 1/17, District of Arizona, 1:2013cv00118; 1:2013cv00119; 1:2013cv00120; 1:2013cv00121; 4:2013cv00041; 1/18, District of Delaware, 1:2013cv00108.
