Kroy IP Holdings filed suit against Safeway alleging that Safeway’s incentive program that enables shoppers to redeem accumulated points for automated award fulfillment infringes a patent related to incentive programs.  Kroy IP Holdings has filed one prior suit since June 2011 against ACI Worldwide, Capita Technologies, Frosch International Travel, LW Acquisition, Loyaltyworks, and Performance Systems Group, and has been subject to one action for declaratory judgment brought by Performance Systems Group.  The patent-in-suit was assigned to Kroy IP by individual inventor, York Eggleston, in April 2011.  12/17, Eastern District of Texas, 2:2012cv00800.
