Landmark Technology Continues to Target Online Retailers

Landmark Technology filed four separate suits against Airgas, Belk, Burberry, and Jos. A. Bank Clothiers alleging that the defendants’ retail websites and electronic data interchange systems infringe two patents related to exchanging electronic business data with trading partners for ordering and receiving goods. According to the complaint, Landmark is the exclusive licensee of the patents-in-suit, one of which received a reexamination certificate confirming the validity of all original claims and allowing 22 additional claims. Since 2008, Landmark has filed suit against dozens of retailers who conduct business through Internet websites. None of the suits have been litigated to a jury trial, and all have concluded either in settlement or voluntary dismissal. Landmark has only been involved in litigation activity involving declaratory judgment twice, one of which the court granted Landmark’s motion to dismiss for lack of personal jurisdiction and the other was a joint stipulation of dismissal. Landmark currently has 18 active cases, all in the Eastern District of Texas, against various online retailers. 12/11.
