EMG Technology filed suit against Alcoa, JC Penney and The TJX Companies alleging that the defendants’ websites infringe a patent related to reformatting HTML content for display on a mobile device. The patent-in-suit is one of two patents that EMG has asserted in 19 suits since November 2008 against more than 55 defendants. The majority of defendants have been e-commerce companies that were sued over mobile websites. The patent-in-suit received a reexamination certificate (attached as an exhibit to each of the complaints) in 2011 that affirmed the validity of the claims as amended, adding a limitation that a link be provided to navigate to a “sister site.” 11/29, Eastern District of Texas, 6:2012cv00903, 6:2012cv00904 and 6:2012cv00905.
