Pragmatus Telecom filed 28 separate suits against 3M, Alcatel-Lucent, Aramark, AT&T, Bright House Networks, Brother, CDW, Comcast, Comdata, Crocs, Enterprise Rent-A-Car, Frontier Communications, GM, HSN, Lands’ End, Lenovo, Lexmark, Nike, OCE-America, Office Depot, Oriental Trading Company, Redbox, Rite Aid, Sprint, Thomson Reuters, U-Haul, Volkswagen, and Wal-Mart, alleging that live chat services provided by the defendants on their websites infringe three patents related to contact center communications.  Pragmatus Telecom has filed 11 prior suits since November 2011 against more than 20 defendants, many of which have been customers of LivePerson.  LivePerson filed a suit for declaratory judgment against Pragmatus Telecom in February 2012.  LogMeIn recently filed a suit for declaratory judgment against Pragmatus Telecom on November 21.  According to the complaint, LogMeIn customers including Build.com, Georgia-Pacific, Lexmark, Trend-Micro and Wal-Mart have received letters from Pragmatus for their implementations of LogMeIn’s BoldChat and Bold Software.  LogMeIn customers have requested indemnification from LogMeIn with respect to Pragmatus’ patent infringement claims.  The three patents-in-suit involved in the newly filed complaints by Pragmatus originated with The New Brunswick Telephone Company and were assigned to Bell Aliant Regional Communications in October 2009.  In August 2011, Bell Aliant assigned four patents and one application including the three patents-in-suit to Pragmatus Telecom. Pragmatus Telecom is the most recent Pragmatus patent enforcement entity. Others include Pragmatus AV and Pragmatus VOD.
