1st Technology Targets More Online Gaming Companies

1st Technology filed five separate suits against Facebook, Hulu, Midasplayer.com, Rovio, and Wild Tangent, alleging that the defendants’ online video games and services infringe one or three patents (depending on the defendant) related to the transmission of compressed multimedia information with the ability to switch between voice and data modes.  1st Technology has filed over 10 prior suits against more than 30 defendants (primarily online gaming related) since 2004.  Dr. Scott Lewis is the named inventor on the patents-in-suit, as well as the controlling manager of 1st Technology.  In 2010, 1st Technology obtained a reexamination certificate for one of the patents-in-suit (’001), confirming the validity of claims 1-32 and adding claims 33, 45-56, 58 and 50.  The reexamination petition was filed in March 2008 by defendant Bodog Entertainment, an online gaming company based in Antigua that 1st Technology sued in 2006.  Bodog never responded to the complaint, and a default judgment of $46.6 million was awarded to 1st Media in 2007.  The parties reportedly reached a settlement in April 2009.  Northern District of Illinois,  1:2012cv09104;  1:2012cv09107; 1:2012cv09139; 1:2012cv09029; 1:2012cv09044.
