PrivaCash Asserts Different Patent against American Express

PrivaCash filed suit against American Express, alleging that American Express gift cards infringe a patent related to “non-personalized” purchase cards.  PrivaCash sued American Express in June 2009 over a different patent. The prior suit was dismissed in October 2010 when Magistrate Judge Stephen Crocker ruled that PrivaCash had failed to offer sufficient proof that American Express gift cards infringed the patent-in-suit and partially granted American Express summary judgment. The Court of Appeals for the Federal Circuit affirmed the decision in August 2011 following an appeal by PrivaCash. To date, PrivaCash has not filed any suits against other defendants. 11/9, Eastern District of Texas, assigned to Judge Leonard Davis, 6:2012cv00869.
