New NPE Campaign Targets Mobile QoS Provider with Open Market Patent

Qexez filed suit against JDS Uniphase, alleging that the defendant’s quality of service  (QoS) system for wireless devices infringes a patent related to QoS for IP connected mobile devices. JDS Uniphase, a provider of broadband and optical network components, has not been sued for patent infringement since 2008.  This is the first patent suit filed by plaintiff Qexez. The patent-in-suit was assigned to Qexez in May 2012.  Mark Baerwaldt is the named correspondent on the assignment to Qexez, as well as the named correspondent on assignments to plaintiff entities Quxuz and Qxzab.  RPX reviewed the patent-in-suit as an open market opportunity (Validus 3G) in October 2009.  10/11, Eastern District of Texas, assigned to Judge Rodney Gilstrap, 2:2012cv00649.
