New NPE Sues Invensys with Open Market Patent

Abarta [NPE] filed suit against Invensys Systems, alleging that the defendant’s SimSci-Esscor EYESIM Immersive Virtual Reality Training System infringes a patent related to a virtual reality system.  This is the first patent infringement suit initiated by Abarta.  RPX reviewed the patent-in-suit as part of an open market opportunity (VOLO) that was offered for sale by IP Offerings in August 2010.  The patent-in-suit was assigned to Volo in 2007, and according to the complaint Abarta is the exclusive licensee and possesses the right to sue for infringement and recover past damages.  10/10, Eastern District of Texas, assigned to District Judge Rodney Gilstrap and referred to Magistrate Judge Roy S. Payne, 2:2012cv00643.
