The US Federal Circuit Court of Appeals denied St. Clair’s petition for Rehearing en Banc in St. Clair v. Canon et al (March 28, 2011). In January 2011, the Court of Appeals overturned a district court’s finding of infringement by Fujifilm (Fuji). At issue in the suit were four patents with claims directed to saving video images in multiple formats. The plaintiff’s had originally received a Markman interpretation that covered cameras operable to save both JPEG and MPEG images. The Court of Appeals overturned the lower court’s claim construction holding that the specification and prosecution history limited the “plurality of data formats” requirement to formats required by different computer architectures.
