New NPE Sues Travel Sites with Open Market Patents

September 26, 2012

Metasearch Systems [NPE] filed four separate suits against Expedia, Hotels.com, Hotwire, Orbitz, Priceline.com, and Travelocity.com, alleging that the defendants’ websites, including trip-planning metasearch services infringe six patents generally related to metasearch results and display of associated ads/product listings.  These are the first four patent infringement suits initiated by Metasearch Systems.  Harvey Lunenfeld is the named inventor on the patents-in-suit, and according to the complaint, Metasearch Systems is the exclusive licensee of the patents.  No assignment information regarding the patents-in-suit has been recorded at the USPTO.  RPX reviewed three of the in-suit patents as an open market opportunity (Lunenfeld-Acq) in November 2010. (The other three in-suit patents issued subsequent to RPX’s review.)  It is unclear whether Lunenfeld retains ownership of  the portfolio.  9/21, District of Delaware, 1:2012cv01188; 1:2012cv01189; 1:2012cv01190; 1:2012cv01191.
