Walker Digital Patent Used to Target Online Help in New Campaign

Community United IP [NPE] (a new plaintiff entity likely under the direct control of IPNav) filed two separate suits against 1-800-Flowers.com, Discover Card, EarthLink, Enterprise Rent-A-Car, Hertz, HSN, LivePerson, Match.com, Oracle, QVC, Travelocity.com, and Verizon, alleging that the defendants’ products and services that incorporate Oracle’s RightNow CX and LivePerson’s communication platforms infringe a patent related to “expert-based” commerce support.  These are the first two patent infringement suits initiated by Community United IP.  The patent-in-suit was co-developed by Priceline founder and Walker Digital chairman Jay Walker, and assigned to Community United IP by Walker Digital in September 2011.  RPX reviewed the patent-in-suit as well as another patent in the Ocean Tomo ICAP Spring 2010 Auction.  9/14, District of Delaware, no judge yet assigned, 1:2012cv01135; 1:2012cv01136.
