September 10, 2012

Eclipse IP [NPE] filed two separate suits against 1st in Video-Music World and Nissan, alleging that the 1st in Video’s electronic order, purchase, and product return status messaging system and Nissan’s NavTraffic navigation system infringe two or five patents (depending on the defendant) related to computer-based notification systems.   The patents asserted in previous cases by Eclipse IP have also been related to computer-based notification systems, and were assigned by the inventor, Scott A. Horstemeyer is reportedly a partner/attorney at the IP law firm, Thomas Kayden Horstemeyer & Risley LLP.  9/5, Central District of California, assigned to Judge George H. Wu and referred to Magistrate Judge Charles F. Eick, 2:2012cv07599; 9/7, Western District of North Carolina, no judge yet assigned, 3:2012cv00581.
