ADC Files New Suit against Kyocera

ADC Technology [NPE] filed suit against Kyocera, alleging that Kyocera’s mobile communication devices sold under the Kyocera and Sanyo brand names infringe a patent related to a portable communication device.  The patent, 8,103,313, was issued in January and has not been the subject of prior litigation.  ADC Technology has filed nine earlier suits against handset companies including Apple, HTC, Kyocera LG, Nokia, Palm, RIM, Sony, and Sony Ericsson.  The previous suits asserted three patents awarded to the same individual inventor, Toshiharu Enmei.  The previous suit filed by ADC against Kyocera was filed in 2010 and was stayed pending re-examination of the in-suit-patents.  Examination of two of the three is ongoing.  The validity of claims 1 through 7 (and a new claim, 8) of a third, 6,985,136, was confirmed in March.  A new re-examination was initiated in May.  ADC is represented by Niro, Haller and Niro. 8/14, Northern District of Illinois, assigned to Honorable Samuel Der-Yeghiayan, 1:2012cv06418.
