Swipe Innovations [NPE] filed three separate suits against Equinox Payments, Hypercom, Ingenico, and VeriFone, alleging that the defendants’ payment terminal products infringe a patent related to encrypting PIN pads.  Swipe has filed 10 prior suits since March 2012 against more than 10 defendants, including Capital One, Fujitsu, Global Payments, Honeywell, Motorola, Orpak USA, TechTrex, TransFirst Holdings, and WorldPay US.  Swipe Innovations has also been subject to one action for declaratory judgment brought by Vantiv.  The patent-in-suit originated with Niobara Research & Development before being assigned to Swipe Innovations by FTE Exchange in November 2011.  8/8, Eastern District of Texas, no judge yet assigned, 9:2012cv00126; 9:2012cv00127; 9:2012cv00128.
