Image-Based Surgicenter (IBSC), NeuroGrafix [NPE], and Neurography Institute Medical Associates (NIMA) filed suit against Brainlab,  the University of Chicago, and the University of Chicago Medical Center, alleging that the defendants’ use of products for peripheral nerve MR Neurography, DTI, and diffusion anisotropy-based tractography, including related workstations and software, infringe a patent related to medical imaging.  NeuroGrafix has filed nine prior suits since May 2008 against defendants, including  Beth Israel Deaconess Medical Center and Children’s Hospital Medical Care Corporation, Beth Israel Deaconess Physicians Organization, Boston Medical Center Corporation, Boston University Affiliated Physicians, Boston University Medical Center Radiologists, Brigham and Women’s Hospital, Brigham and Women’s Physicians Organization, Caregroup, Harvard Medical Faculty Physicians at Beth Israel Deaconess Medical Center, John Hopkins Hospital, John Hopkins University, Oak Tree Medical Corporation, Partners Healthcare System, Philips, Siemens, University of California, President and Fellows of Harvard College, Trustees of Boston University, Trustees of Tufts College, Tufts Medical Center Physicians Organization, and Tufts Shared Services. The plaintiffs have also been subject to one action for declaratory judgment brought by GE in May 2012.  The patent-in-suit was assigned to the University of Washington by St. George’s Hospital Medical School in February 2008.  According to the complaint, Washington Research Fund holds all rights to the patent-in-suit, which was exclusively licensed to NeuroGrafix in December 1998.  NeuroGrafix, NIMA, and IBSC have reportedly been investing in and practicing the technology in the patent-in-suit since at least 2000.  8/1, Northern District of Illinois, no judge yet assigned, 1:2012cv06068, 1:2012cv06075.
