Fiber [NPE] filed suit against Ciena, alleging that Ciena’s optical switching products infringe two patents related to optical switches.  This is the second patent infringement suit initiated by Fiber.  Fiber previously filed suit against NEC in May 2012.  The patents-in-suit originated with Texas Instruments and were assigned to Fiber by AFN in April 2002.  RPX reviewed the patents as an open market opportunity (American Fiber Networks) in August 2011.  7/23, District of Colorado, no judge yet assigned, 1:2012cv01914.
