Excentus Files DJ against CodePro Innovations

Excentus filed an action for declaratory judgment against CodePro Innovations [NPE], seeking declaration that its fuel discount loyalty program does not infringe two patents related to the use of discount codes and loyalty program information in retail point-of-sale transactions.  CodePro Innovations has filed one patent infringement suit since June 2011 against Blockbuster, JC Penny, Kohl’s and Redbox over the same two patents.  According to the complaint, CodePro sent letters to Excentus and its customers in May 2012 that included allegations that the recipients were infringing the patents-in-suit.  The patents-in-suit (issued in 1998 and 1999) were assigned by CodePro to a patent investment entity Mount Hamilton Partners in 2006.  Mount Hamilton Partners later assigned the patents-in-suit to I2Z Technology in December 2010, which transferred their interest to CodePro in February 2011.  6/22, Northern District of Texas, assigned to Judge Sam A.
