US Ethernet Innovations Sues Netgear and Samsung

US Ethernet Innovations (USEI) [NPE] filed two separate suits against Netgear, Oki Data Americas, and Samsung, alleging that the defendants’ routers, network printers, and point of service printers infringe four patents related to Ethernet technology.  USEI has filed 12 prior suits since October 2009 against over 35 defendants, including AcerApple,ASUSAT&TBarnes & NobleCanonDellFujitsuGatewayHPIntelMarvell, NVIDIASonyTexas InstrumentsToshibaTrendnet, and Xerox, and has been subject to three actions for declaratory judgment.  The patents-in-suit originated with 3Com and were assigned to USEI in October 2009.  According to the USEI website, the entity “was formed to continue 3Com Corporation’s successful licensing program on behalf of its portfolio of foundational patents in Ethernet technology.”  HP acquired 3Com in 2009.  RPX reviewed the patents-in-suit in the open market in February 2009 (3Com – Acq).  6/22, Eastern District of Texas, assigned to Judge Leonard Davis, 6:2012cv00398; 6:2012cv00399.
