Three Medical Device Companies Sue Philips

Image-Based Surgicenter, NeuroGrafix, and Neurography Institute Medical Associates [NPE] filed suit against Philips and Invivo Corporation, alleging that the defendants’ products for peripheral nerve MR Neurography, DTI and diffusion anisotropy based tractograpjy, including related workstations and software infringe a patent related to medical imaging.  NeuroGrafix has filed three prior suits since May 2008 and has been subject to one action for declaratory judgment brought by GE.  The patent-in-suit was assigned to University of Washington by St. George’s Hospital Medical School in February 2008.  According to the complaint, Washington Research Fund holds all rights to the patent-in-suit, which was exclusively licensed to NeuroGrafix in December 1998.  6/15, District of Massachusetts, Judge Judith G.
