Elia Data of Texas Sues IBM

June 13, 2012

Elia Data of Texas [NPE] filed suit against IBM, alleging that IBM’s Tivoli, Websphere, Lotus, and SPSS products/systems infringe a patent related to providing secure transport of secure packets between a first and second node.  Elia Data has filed two prior suits since April 2012 against Citrix and Microsoft.  According to the complaint, Daniel Perez is the president of Elia Data.  Perez has been linked to several past NPE litigation campaigns.  The patent-in-suit was assigned to Elia Data by inventor, Sandy Kronenberg in January 2012.  RPX reviewed the patent as an open market opportunity “Kronenberg” in September 2011.  The patent was marketed with claim charts relating the patent to peer to peer networking.  6/12, Eastern District of Texas, Judge Michael H. Schneider, 2:2012cv00320.
