Fiber [NPE] filed suit against NEC, alleging that NEC’s optical switching products infringe two patents related to optical switches.  This is the first patent infringement suit initiated by Fiber.  The patents-in-suit originated with Texas Instruments and were assigned to Fiber by AFN in April 2002.  RPX reviewed the patents as an open market opportunity (American Fiber Networks) in August 2011.  5/23, District of Colorado, Judge Marcia S.
