March 30, 2012

Ameranth [NPE] filed nine separate suits against Domino’s Pizza, GrubHub, O-Web Technologies, OpenTable, Papa John’s, Par Technology, Pizza Hut, QuickOrder, Seamless, and TicketMob, alleging that the defendants’ websites and apps infringe a patent related to online ordering.  Ameranth has filed four prior suits since June 2007 against over 20 defendants and been subject to two actions for declaratory judgment.  Ameranth filed suit against the named defendants in an earlier suit, but these new cases assert a new patent that was issued on March 27, 2012 and originated with AT&T.  Ameranth claims to be the owner by assignment of the patent-in-suit, but this has yet to be recorded by the USPTO.  3/27, Eastern District of Texas, 2:2012cv00164; Southern District of California, 3:2012cv00729; 3:2012cv00731; 3:2012cv00732; 3:2012cv00733; 3:2012cv00737; 3:2012cv00738; 3:2012cv00739; 3:2012cv00740.
