Round Rock Sues Wal-Mart

Round Rock Research [NPE] filed suit against Wal-Mart, alleging that Wal-Mart’s RFID products infringe ten patents related to RFID identification readers and tags.  Round Rock acquired the patents-in-suit from Micron Technology in 2009, and has filed over 15 prior suits since October 2010 against defendants including Acer, Amazon, ASUSTek, Dell, Gateway, HTC, and Oracle.  Round Rock has also been subject to three actions for declaratory judgment brought by ASUSTek, Motorola, and Sandisk.  Round Rock has reportedly licensed its portfolio to Apple, Nokia, Samsung and Sony, and an unknown buyer purchased a Round Rock covenant not to sue for over $35M at the ICAP Ocean Tomo Spring 2011 auction.  Round Rock was formed by John Desmarais, the former head of patent litigation at Kirkland & Ellis.  3/20, District of Delaware, 1:2012cv00362.
