New NPE Sues Amazon over Pricing

OIP Technologies [NPE] filed suit against Amazon, alleging that Amazon’s website infringes a patent related to pricing automation.  This is the first patent infringement suit initiated by OIP.  The patent-in-suit originated with Resonant Commerce (later known as Optivo) and was assigned to OIP in October 2004.  Andrew Atherton and Vladimir Gorelik are the founders of Resonant Commerce / Optivo and two of the named inventors on the patent-in-suit.  The complaint alleges that they were in negotiations with Amazon about the technology when Amazon declined to purchase Optivo and instead hired two Optivo engineers.  OIP was established as Optivo’s successor to monetize the patent-in-suit.  3/12, Northern District of California, 3:2012cv01233.
