On March 8, 2011, Ryonet, a supplier of screen printing equipment, filed an action for declaratory judgment against Lodsys [NPE], seeking declaration that its use of Provide Support’s customer chat service does not infringe four patents related to a customer-based product design module. Lodsys frequently targets smaller, downstream users of a larger company’s products. In 2011, Lodsys sued a number of small iOS and Android developers. Lodsys has also threatened litigation against customers of Bold Software, ForeSee Results, LivePerson, OpinionLab, PC Drivers, and RightNow Technologies in similar fashion, prompting each of those companies to file actions for declaratory judgment against Lodsys. Lodsys appears to now be targeting users of Provide Support’s customer chat.
