Ryonet filed an action for declaratory judgment against Lodsys [NPE], seeking declaration that its use of Provide Support’s customer chat service does not infringe four patents related to a customer-based product design module. According to the complaint, Lodsys sent Ryonet claim charts purportedly demonstrating Ryonet’s alleged infringement and encouraging Ryonet to take a license. Since February 2011, Lodsys has filed four patent infringement suits, and has been subject to 11 prior actions for declaratory judgment. The patents-in-suit were assigned to Ferrara Ethereal and Webvention before being assigned to Lodsys in August 2010. 3/8, Western District of Washington, 3:2012cv05205.
