Swipe Innovations [NPE] filed suit against Elavon, First Data, Fujitsu, Gilbarco, Heartland Payment Systems, Honeywell International, Motorola, Nautilus Hyosung, Vantiv, ViVOtech, Vix Technology, and Wincor Nixdorf, alleging that the defendants’ payment terminal products infringe a patent related to encrypting PIN pads.  This is the first patent infringement suit filed by Swipe innovations.  In the complaint, Swipe Innovations argues that the defendants are properly joined because the alleged infringement is the result of each defendant practicing the same industry standards.  The patent-in-suit originated with Niobrara Research & Development before being assigned to Swipe Innovations by FTE Exchange in November 2011.  3/7, Eastern District of Texas, 9:2012cv00040.
