December 16, 2011

Round Rock Research [NPE] filed nine separate suits against American Apparel, Dole, Fruit of the Loom, Gap, Hanesbrands, J.C. Penney, Macy’s, PepsiCo, and VF Corporation, alleging that the company’s RFID products infringe four patents related to RFID identification readers and tags.  Round Rock acquired the patents-in-suit from Micron Technology in 2009, and has filed six prior suits since October 2010 against Acer, ASUSTek, Dell, Gateway, HTC, and Oracle.  Round Rock has licensed its portfolio to Apple, Nokia, Samsung and Sony, and an unknown buyer purchased a Round Rock covenant not to sue for over $35M at the ICAP Ocean Tomo Spring 2011 Auction.  Round Rock was formed by John Desmarais, the former head of patent litigation at Kirkland & Ellis.  12/14, District of Delaware, 1:2011cv01242.
