NPE Sues Computer Information Network and SportsDirect

DDB Technologies [NPE] filed two separate suits against Computer Information Network and SportsDirect, alleging that the company’s online simulations of live sporting events infringe four patents related to internet broadcasting.  DDB has filed ten prior suits since April 2010 against defendants including AOL, ESPN, and Yahoo. David Barstow and Daniel Barstow are the named inventors of the patents-in-suit and the founders of DDB.  In June 2004, DDB sued MLB Advanced Media (MLBAM).  However, David Barstow’s employer, Schlumberger Technology Corporation, claimed ownership of the patents and assigned them to MLBAM and successfully moved to dismiss DDB’s case.  On appeal, the Federal Circuit remanded the case to determine proper ownership based on whether the patents were created in the scope of David Barstow’s employment with Schlumberger.  Schlumberger assigned the patents to DDB in March 2010.  11/1, Western District of Texas, 1:2011cv00934; 1:2011cv00942.
