ASUS Tablets Targeted by Acacia’s Smart Phone Technologies

Acacia Research-subsidiary Smart Phone Technologies (SPT) filed suit against ASUS in the entity’s first new litigation since February. ASUS’ tablets are accused of infringing the asserted patent that relates to a distributed web site where data for the site is stored on an individual mobile device and a network server (RE40459). It has only been asserted in one previous SPT case, filed in 2010 against Blackberry. That is consistent with SPT’s general litigation assertion strategy. The entity asserts each of its patents in only a handful of cases; most of its litigated patents have been used in five or fewer litigations. 3Com is the original owner of the asserted patent and transferred it to Palm in 2000. The patent was acquired by ACCESS during its acquisition of Palm-subsidiary PalmSource and is currently owned by that company; SPT is the exclusive licensee. 10/23, Eastern District of Texas, 6:13cv00807
