RPost Sues Yesware as Yesware Files for Declaratory Judgment

On the same day that Yesware filed a motion for declaratory judgment against RPost, the entity filed an infringement suit against the company naming Google, a customer of Yesware’s products, as co-defendant. The suit asserts three patents related to aspects of verified email delivery, including verifying email receipt, opening, and the content of a reply (8,161,104; 8,275,845; 8,468,198). Yesware’s declaratory action states that it has received two assertion letters from RPost, in late October and early November, alleging that Yesware’s email tracking service infringes the patents-in-suit. Google is also accused of infringing the patents in RPost’s suit based on its use of Yesware’s tracking services as a plugin for GMail. RPost has asserted two of the patents-in-suit in previous litigation but the ‘198 patent has not previously been used in litigation. All three patents were developed by RPost which sells a registered email service in addition to its patent assertion activities.
