Individual Inventor Sues Square

Individual inventor Fernando Morales filed suit against Square this week asserting a patent that has previously been the subject of litigation between the parties. In April 2013 Square filed a motion for declaratory judgment of noninfringement of patent 5,872,589, which relates to an interactive mass media distribution system for television. That motion was dismissed for lack of personal jurisdiction after the court found that Morales did not have sufficient contacts with Northern California. Evidence that Morales attempted to meet with Square’s legal counsel in San Francisco and sent assertion emails to the company was insufficient to meet the minimum ties necessary.  12/3, Western District of Texas, 5:13cv01092
