Fenner Investments [NPE] filed suit against Cellco Partnership (Verizon Wireless) and MetroPCS over a patent related to mobile billing.  The patent-in-suit was issued to inventor Peter R. Fenner in 1996 and was the subject of two prior suits.  UTStarcom filed for declaratory judgment in 2005. That suit was dismissed after four months.  Fenner subsequently sued Alcatel-Lucent in 2006.  That suit was dismissed after three months.  Fenner Investments has asserted other patents against technology companies including  HP, Juniper Networks, and Microsoft.  7/6, Eastern District of Texas, 6:2011cv00348.
