New NPE Modern Telecom Systems (MTS) asserted six modem patents in lawsuits against AOL, Earthlink, Juno Online Services, and Netzero last week. Each of the three suits allege the defendants’ dial-up Internet services infringe six patents related to dial up modem systems (5,970,100, 6,332,009, 6,504,886, 6,570,932, 6,819,749, 7,062,022). MTS argues that defendants are inducing customers to infringe the patents by providing them with lists of local access numbers using V.90 or V.92 modems to connect to dial-up Internet service.
