New WiLAN Sub Accusing Device Makers of Infringing Wireless Networking Patents

New NPE and WiLAN subsidiary Open Network Solutions filed suit against Advanced Digital BroadcastAmazonCanonCavium, DirecTV, GoogleHyosung, MicrosoftPhilips, Seiko Epson, and Wincor. All 11 suits assert a pair of patents related to communication between devices over a network (6,745,2596,907,476). The complaints filed against Hyosung and Wincor assert a third patent related to an automated teller machine for implementing transactions over the Internet (6,850,996). Defendants’ devices that permit wireless communication and media streaming over a network are accused of infringing the patents-in-suit. Datascape is the original owner of the patents and asserted the ‘259 and ‘476 patents in litigation between 2004 and 2009. The patents-in-suit were then assigned to Open Network in April 2014. RPX saw the patents-in-suit offered on the open market as part of a larger portfolio in March 2014 (Datascape OMA). The ‘476 patent is currently going through reexamination.  A non-final action from December 2012 rejected all claims subject to reexam (2, 4, 5, and 13-15), but no final decision has been mailed.
