Daniel Perez’s New NPE Asserts a Website Monitoring Patent Against OpinionLab

May 22, 2014

Etamental, a new NPE run by Daniel Perez, filed suit against OpinionLab for alleged patent infringement. The asserted patent relates to monitoring browsing activity of visitors to a website (6,895,437). The complaint accuses OpinionLab’s website feedback, mobile feedback, data collection, and reporting services of infringing the patent-in-suit. The ‘437 patent originated with Usability Sciences, and Etamental’s complaint states that the NPE owns the patent through an assignment. This appears to be the first time ‘437 has been litigated. RPX reviewed the patent as an open market opportunity in October 2012 (Usability Sciences-OMA). 5/14, Texas Eastern District Court, 2:14cv00628
