New REC Suit Expands Focus to Mobile Operating Systems

  • July 14, 2014

REC Software, which hadn’t filed suit since 2011, reignited its campaign with suits against Casio, DellHTC, Huawei, Kyocera, LG, Motorola Mobility, Pantech, Samsung, Sony, and ZTE. The new filings assert the same patent it used in previous litigation (5,854,936). The ‘936 patent, developed by REC, relates to a code server for retrieving coded programs. It is unclear whether REC previously was an operating company but at the time of these filings it does not appear to make or sell any software or services. Defendants’ smartphones are the accused products in this recent case; REC’s previous suits have accused computer operating systems of infringing the asserted patent. The entity’s only previous suit, against Bamboo Solutions, Microsoft, and SAP, concluded in September 2013 after Microsoft, the only remaining defendant, was dismissed with prejudice. 7/8, Western District of Washington, 2:14cv01025, 7/11, Western District of Washington, 2:14cv01047, 2:14cv01048, 2:14cv01050, 2:14cv01051, 2:14cv01053, 2:14cv01056, 2:14cv01058, 2:14cv01059, 2:14cv01060, 2:14cv01062
