Judge Invalidates Two ITUS (CopyTele) Loyalty Conversion Patents

Texas Circuit Judge William Bryson ruled last week that two ITUS (formerly CopyTele) patents are invalid because they are directed to unpatentable subject matter. The patents (8,313,023, 8,511,550) relate to computerized systems for managing airlines’ loyalty programs. ITUS subsidiary Loyalty Conversion Systems asserted the patents in suits against American Airlines, Alaska Air, Delta, Frontier, Hawaiian, JetBlue, Southwest, Spirit, US Airways, and United in August 2013. The ten separate complaints accused the airline companies’ frequent flier programs of infringing the ‘023 and ‘550 patents.
