NPE Expands Campaign Targeting Online Retailers

October 2, 2014

DataTech IP expanded its campaign, begun earlier this year, by adding four new defendants: Acer, Golfsmith, Olympus, and Williamson-Dickie Manufacturing. The campaign asserts a single patent related to assembling an electronic document using stored data (6,895,554). The suits allege that defendants’ e-commerce websites offer document creation services for the purpose of billing and shipping goods, which infringe the asserted patent. DataTech began its campaign in May of this year, asserting the ‘554 against Pioneer Electronics in a case that is still ongoing. The patent originated with DataTech Software, a former operating company run by the patent’s co-inventor, Matthew Endress. It was assigned to DataTech in March 2014. RPX reviewed the asserted patent as part of an open market opportunity in August 2013 (Endress – OMA). 9/30, Eastern District of Texas, 2:14cv009142:14cv00915, 2:14cv00916, 2:14cv00917
