NPE Asserts Patent with Assignment History Linked to Intellectual Ventures

June 28, 2011

Secure Axcess [NPE] filed suit against Dell and 11 others, including a number of e-commerce and financial services companies, over a patent related to encrypted cookies.  Secure Axcess filed suit against Bank of America, ING, and 30+ regional banks in December 2010 for alleged infringement of a patent related to web page authentication. (As of now there have been no dismissals in that case.)  According to the PTO, prior assignee “Intellectual Ventures Finvention, LLC” assigned rights to the patent asserted in the December suit to an entity called Zamalchi Research in an assignment recorded on December 10, 2010.  This is the first time the patent in the current suit has been litigated.  PTO assignment records show the patent in this newest suit was also assigned to Secure Axcess by Zamalchi Research in November 2010.  Secure Axcess’ web site notes that the company was founded by Prism Technology (an NPE with an extensive litigation history).  6/27, Eastern District of Texas, 6:2011cv00338.
