Two Patents Previously Shot Dead Are No Deterrent to Implicit’s Assertion of Other “Bullet-Proof” IP

Inventor-controlled NPE Implicit, LLC has filed another wave of cases in the litigation campaign that it began in early 2008. The new defendants are Ericsson (6:16-cv-00075), Huawei (6:16-cv-00076), NEC (6:16-cv-00078), Nokia (6:16-cv-00079), and Trend Micro (6:16-cv-00080). The complaints assert two patents (8,694,683; 9,270,790) against all five defendants and two additional patents (6,324,685; 8,856,779) against all defendants but Trend Micro. The patents-in-suit generally relate to the dynamic download of applications based on analyzing user requests. Implicit focuses its infringement allegations on products that act as network gateways and/or engage in deep packet inspection.
